When Employees in Los Angeles Are Entitled to Overtime Pay

So, when are you entitled to overtime pay? If you are protected under the California Labor Code, you are entitled to overtime pay if either:

  • You work more than eight hours in any one day;
  • You work more than 40 hours in any week; or,
  • You work more than six days in any week.

Under California law, you are entitled to overtime pay any time you exceed any one of these thresholds. In contrast, you are only entitled to overtime pay under the federal FLSA if you work more than 40 hours in a “workweek,” which is defined as a “fixed and regularly recurring period of 168 hours,” or seven consecutive 24-hour periods. In most cases, overtime pay is calculated as one-and-a-half times your normal hourly wage. However, it is calculated as double your normal hourly wage in some cases. As is often the case, there are exceptions. Under California and federal law, “exempt” employees are not entitled to overtime pay—no matter how many hours they work in a day or workweek.
